PENAL LAW

Description

The definition of this legal area refers to the rules or set of rules, the purpose of which is to defend victims against different types of criminal offences.

When speaking of penal law, the term is used with different meanings, according to what one wishes to refer to; thus, one can speak in a preliminary way of a substantive penal law and, on the other hand, of an adjective penal or procedural penal law.

The first of these is constituted by what is generally known as the criminal code or substantive criminal laws, which are the rules promulgated by the State, setting out the offences and penalties, while the law of criminal procedure is the set of rules designed to establish the manner in which they are to be applied.
